Zgodnie z § 312g ust. 2 pkt 3 niemieckiego Kodeksu cywilnego (BGB) prawo odstąpienia od umowy nie przysługuje w przypadku zapieczętowanych towarów, których ze względu na ochronę zdrowia lub higienę nie można zwrócić, jeśli opakowanie zostało otwarte po dostarczeniu.

Po otwarciu opakowania lub dopasowaniu ochraniacza do uzębienia zwrot lub odstąpienie od umowy są wykluczone.
